The court rulings came to light shortly after BMW Oracle loaded the trimaran and wing rig onto a container ship in San Diego.

"It's a big step forward," said Tom Ehman, spokesman for the Golden Gate Yacht Club in San Francisco, which BMW Oracle represents. "We are pleased but not surprised that the appellate body has upheld the inadmissibility of (the precinct) Rash al-Khaimah."

The Swiss grudgingly took note of the decisions. "Once again, BMW Oracle's strategy of trying to win the Cup in court rather than on the water," said Fred Meyer, vice commodore of the Société Nautique de Genève, which sponsors Alinghi. “For the first time in history, the cup defender was deprived of the basic right to choose the venue. Société Nautique de Genève accepts the decision and is looking forward to the races for the America’s Cup in the waters of Valenci in February 2010."

As far as we know, the first of a maximum of three scheduled races is scheduled for February 8, 2010. But negotiations are also ongoing to extend the series to a maximum of seven races.
